I’m guessing it’s the lovely rule that out-of-court statements uttered by non-declarants cannot be offered into evidence at trial to prove the truth of the matter asserted (with exceptions, of course).
That’s part of it, yes. But I hate ‘em all right now. The looming menace of a closed-book, multiple-choice, four-hour, 4-credit exam in less than 22 1/2 hours will do that to a person…
There’s a reason people call it “Evidence in a Flash” - Smitty takes problems DIRECTLY from the flash cards. I hope you’ve got ‘em, if not, 19 1/2 hours is still enough time.
He also takes questions directly from the ExamPro Series evidence book. Apparently he just goes around to all of the different study guides and lifts questions to use on his test….Lazy

My evidence final was a similar format. FWIW, evidence was the class in which I derived the most benefit from using flash cards.
