Alleged Sanchez assault reportedly happened after he left the 9-0

***UPDATE, 12:10 PM: In order to prevent confusion, I’ve rewritten the beginning of this post, deleting the portions that turned out to be inaccurate (specifically, the notion that the alleged assault possibly happened at the 901 Club). I’ve moved the deleted portions to the bottom of the post, after the jump, for the sake of the historical record.***

Update on the Mark Sanchez case… according to the timeline established by the L.A. Daily News and the L.A. Times, the alleged sexual assault is said to have taken place at Cardinal Gardens in the wee hours of Wednesday morning after Sanchez returned from a night of boozing at the 901 Club, more commonly known among USC students as “the 9-0.” (For the uninitiated, you can read more about the 9-0, which is sort of like USC’s version of the Backer, from Playboy.com — some links possibly NSFW, duh.) The Times reports:

According to an employee of the 901 Club on Figueroa Street, club security cameras show Sanchez arrived at the bar Tuesday night at 11:21, using a fake Arizona ID that showed his name as Jordan Traver Uttal.

“I saw him and he was stoned-faced sober when he came in,” said the employee, who asked not to be identified by name.

The club, known by USC students as “The 9-0,” is about a 10-minute walk from Cardinal Gardens.

Earlier in the article, it states:

The security system at [the 9-0] shows [Sanchez] leaving at 12:59 a.m. Wednesday.

“He left by himself,” [the] employee said. “There was no girl with him.”

After leaving the 9-0, Sanchez apparently went home to Cardinal Gardens:

USC students Matthew Menjou and Altman Tsang, roommates who live in a building adjacent to where Sanchez was taken into custody, said Sanchez happened upon them in a parking lot behind the apartment buildings about 1:30 a.m.

Menjou, from Torrance, said he and Tsang, who is from Centerville, Va., said they had returned from getting something to eat when the car they were in ran out of gas just as they prepared to park.

Menjou said Sanchez, whom he recognized from photos as a football player who was supposed to be “the next Matt Leinart,” showed up and offered to help them push the car into a space.

Menjou said Sanchez was loud and appeared as if he had been drinking alcohol.

It was upon Sanchez’s return to Cardinal Gardens — presumably after the encounter with Menjou and Tsang — that the alleged assault is said to have occurred, according to the Daily News:

Witnesses said Sanchez went to an off-campus bar Tuesday night and was dropped off around 1:30 a.m. at Cardinal Gardens, where he met the alleged victim, who also lives in the complex.

[ADDENDUM: Earlier reports stated that the alleged victim says Sanchez was assaulted at or around 12:30 a.m. But the Daily News says he met her at Cardinal Gardens “around 1:30 a.m.” or shortly thereafter. So, there is an inconsistency in the timeline there. What conclusions we should draw from that is anybody’s guess at this point.]

Obviously, the big story here is the alleged assault. But I think the 9-0 could be in some trouble as well, with this high-profile publicity for letting in an underage drinker. They have an anonymous employee admitting that Sanchez, who is 19, got in with a fake ID — and, keeping mind that the 9-0 has gotten in trouble for that sort of thing in the past, methinks this incident could spell trouble for the club, whatever it ultimately means for Sanchez and the USC football team.

P.S. Who is “Jordan Traver Uttal,” the name on Sanchez’s fake ID? I don’t know, but there is a “Jordan Uttal Fan Club” on MySpace, and most or all of its members seem to be affiliated with USC. At least five “Fan Club” members are also part of “USC Trojan Players,” another MySpace group. Unfortunately, the “Fan Club” is private, so I can’t get any more information about it than that. I can speculate, though. Could it be a sort of underground “fan club” for Sanchez, also known as Uttal to his drinking buddies? I dunno, but it seems plausible. P.P.S. You can view Sanchez’s booking information from the LAPD here. His bail has been set at $200,000.

The L.A. Daily News, which reported that campus security detained Sanchez in March after he allegedly broke a window at a fraternity party but did not make any arrests, said the quarterback attended a workshop Tuesday night at Heritage Hall for athletes on rape awareness.

MORE ON UTTAL: In addition to the MySpace “Fan Club,” there is also a Ventura County Star article on Lexis-Nexis from October 14, 1999, talking about a high-school senior named Jordan Uttal who played for the football team at Westlake High in Westlake Village, CA (near Thousand Oaks). There’s another article from the March 10, 2001 L.A. Times Valley Edition mentioning the same Uttal (apparently) as one of five defendants in a lawsuit by Kelly O’Brien and Kevin Majorino of Thousand Oaks, alleging assault, battery and intentional infliction of emotional distress at a party in Thousand Oaks in March 2000 (when Uttal would still have been a senior in high school). And then, on a rather different note, the San Luis Obispo Tribune on November 23, 2001 noted in an article about The Mortgage House Inc. that “Jordan Uttal serves as loan officer for special programs for the county.” I’m not certain if that’s the same Uttal; San Luis Obispo is more than 160 miles north of Thousand Oaks and Westlake Village. This photo caption seems to suggest that Uttal was still living in Westlake Village as of September 2004, so perhaps not. Anyway, that’s all the even potentially relevant information that I’ve been able to dig up (I’m assuming this is a different Jordan Uttal), and it doesn’t really tell us much of anything, except that maybe, possibly, perhaps, there is a former high-school football player by the name of Jordan Uttal who lives in the L.A. area. Whether that has any connection either to the MySpace “Fan Club” or to Sanchez’s fake ID, I have no idea. Considering it was a fake Arizona ID, and there is nothing in those old news articles linking Westlake’s Jordan Uttal to USC, maybe not. The MySpace thing seems the most likely to be relevant; the presence of other Jordan Uttal(s) in Southern California may just be coincidental and unrelated.

ABOUT THE DT The Daily Trojan article doesn’t add anything we didn’t already know about the basic facts of the case, but it does add some “color,” in terms of what happened on campus and how students reacted:

LAPD and USC Department of Public Safety officers and detectives circled the parking lot outside Sanchez’s building in Cardinal Gardens Wednesday afternoon.

As students entered and exited the complex, most appeared confused about the situation.

Students sat around on their stoops while football players later gathered around the complex to try to understand the situation.

Brian Cushing, a freshman linebacker on the football team and Sanchez’s roommate, was questioned by DPS officers but not arrested by police.

LAPD did not arrest any students besides Sanchez, the LAPD spokesman said.

Students familiar with Sanchez expressed their surprise.

“I was in shock because I have never felt threatened by Mark before,” said Jessica Perlman, a freshman majoring in theater. “He’s always been a sweetheart and always says hello.”

She added: “I’ve hung out with him on my stoop late at night and have always felt comfortable around him.”

A student walking out of the apartment complex voiced his frustration with the situation.

“He’s a good guy, and I see him all the time,” said Chad Thurman, a junior majoring in philosophy. “With Duke happening, and everything, it’s just another way to cause controversy.”

A couple of inside-baseball notes about the DT. If you look at the front page (see below), you’ll notice that the “Finals” note at the bottom of the page reveals that this is actually the last Daily Trojan issue of the semester… which also means it’s the graduation issue (notice that it’s 32 pages long — twice as big as usual because of all the extra graduation ads — that always happens with the final issue of the spring semester)… so EVERYONE will be reading about the initial details of the Sanchez case over the next few weeks … parents, alums, new grads … regardless of how the case actually turns out, the initial report will remain fixed as the top story in every DT that’s lying around campus for the next several weeks!!

Also… typically, the DT senior editors have a drunken end-of-semester bash in the newsroom after putting the final issue to bed… so, holy cow, this must have been an unexpectedly interesting night for them! There they were, calmly putting together the final issue and getting ready to party, when — BAM! — they find out at 7:00 PM that the Trojan quarterback has been charged with sexual assault!! I’d really love to hear the war stories about that one from this semester’s crop of editors. This definitely rivals any of the breaking-news dramas I had to deal with as Assignment Editor and then City Editor (the 2000 election, the Seattle earthquake, the parking-structure suicide, the late-breaking Student Senate election controversy stuff… ah, the memories…)

Anyway, as promised, here’s what the front page — completely revamped in the final hours before proofs, no doubt — looks like:

Update on the Mark Sanchez case… although the Daily Trojan is talking about this as an “alleged sexual assault in Cardinal Gardens,” the L.A. Times reports that “police would not say where the alleged assault occurred,” and witnesses place Sanchez at the 9-0 during the time when the alleged assault is said to have occurred (”about 12:30 a.m,” according to previous reports). Excerpt:

    Wow, it is INCREDIBLY irresponsible for you, especially a law student, to use your well-read blog to speculate on an ongoing investigation and even hinting at the possibility of the alleged victim in this case as a liar. I know you went to the big and bad USC, but this goes way beyond school loyalty. Its disgusting and irresponsible. Wait until more FACTS come out and official POLICE statements before posting such opinionated and NONSENSE. Might I add that the alleged victim is also a student at USC? Show HER some loyalty.

    I’m not hinting that she is a “liar” any more than I am hinting that Sanchez is a rapist. WE SIMPLY DO NOT KNOW. This has nothing whatsoever to do with school loyalty. It would be “disgusting and irresponsible” to assume anything — either that Sanchez committed a crime, or that he didn’t. Which is precisely why I’m not doing that. I don’t know where you see me posting that I think she’s lying, but you’re definitely reading something into my words that simply isn’t there. If you’re offended by my use of words like “allegedly,” well guess what, that’s what this is — an ALLEGATION. It would be “disgusting and irresponsible” for me to NOT use the word “allegedly” when I’m talking about an alleged crime where no charges have even been filed! Seriously, get real, your criticism totally lacks merit.

    P.S. Perhaps it was my use of the word “supposedly” that ticked you off? I simply used “supposedly” because I didn’t want to use “allegedly” twice in a row: “alleged assault allegedly occurred” sounds dumb. Do you have a better suggestion than “supposedly”? I’m all ears.

    One thing is clear: I’m not jumping to conclusions about this case, but you most definitely are jumping to conclusions about my motives.

    P.P.S. I changed “supposedly occurred” to “is said to have occurred.” I didn’t intend “supposedly” to be biased but I can see how it might come off that way… though your assumption that I’m accusing the alleged victim of lying is TOTALLY uncalled for regardless.

    Was there anything else you objected to? So far as I can tell, I’m just doing what everyone else is doing, in the media and blogs and everywhere else… trying to piece together what we know, without jumping to conclusions. That’s all we can do.

    You tend to “over-defend” yourself. Any reasonable mind would know that you want the best outcome for Sanchez, but if he did commit a crime by all means he should pay for his tragedy and still hope the best for him–or any human being for that matter. Noone doubts you’re a reasonable person trying to put the pieces of the puzzle together. The news, however, just ruins my day :O(

    To that, Roger, I will plead guilty: I do tend to “over-defend” myself. :) Anyway, thanks for the moral support.

    As for what I want… do I want the “best outcome for Sanchez”? I don’t know; it’s hard to know what to hope for in cases like this. Do I want Sanchez to not have raped anyone? Sure, but then that would mean he’s been falsely accused, and that sucks almost as much. Ruth Sheehan had a good column about this, re: the Duke lacrosse case. No matter what, there are no winners here.

    To be perfectly clear, let me say this. While your compassion for “any human being,” even one guilty of assault, is admirable, my personal feeling is that if Sanchez did in fact rape or sexually assault someone, I hope they throw the book at him, possibly two or three books, and I hope he rots in jail and possibly hell. As someone who has known multiple victims of sexual assault, I have very little compassion for those who commit it.

    And if, by chance, the allegation is a lie, I hope the accuser gets the book thrown at her, not only because false sexual assault allegations are incredibly damaging to the accused person, but perhaps even more importantly, because they are incredibly damaging to future genuine victims of sexual assualt. Again, see Ruth Sheehan.

    But, to be perfectly clear, I have NO REASON to believe that the allegation is a lie, and I’m certainly not assuming or “hinting” that it is. But nor am I assuming or “hinting” that it is true — that would be both wrong and libelous, because it would make Sanchez a criminal before he’s even been charged, let alone convicted. He is innocent in a court of law until proven guilty beyond a reasonable doubt, and he is innocent in the court of public opinion at least until some sort of actual evidence has been presented which would allow us to make a reasonable judgment — and it’s way too early for that. For now, we simply don’t know, and we don’t have any basis to judge. So I am merely reporting the facts as I understand them, and trying to figure out what can be ascertained from the available facts (e.g., last night when I figured out that the building in question was Cardinal Gardens). I might “speculate” about extraneous facts (e.g. the Cardinal Gardens thing, or whether the timeline suggests that the alleged assault is said to have happened at the 9-0, or who “Jordan Uttal” is), but I’m certainly not going to speculate about guilt or innocence of either party, in anything more than a purely hypothetical sense (see above).

    Needless to say, loyalty to my school has NOTHING to do with my opinion of this case. Rape and sexual assault are about a thousand times more important than football or school loyalty. My opinion of this case will be based entirely on what the facts show. For now, we simply do not know that, and thus, I absolutely will not assume either that Sanchez is guilty or that he is not guilty. There is no basis yet for me to make any sort of judgment.

    BTW: You’re right about the last defense you made on your behalf. Sure thing, we all make our own beds. But, it hurts to see SC name smeared over something like this. Ah, the dilemma! Imagine the odds. USC accuses UCLA of something, or vice-versa. Sure would splice things up a notch–psychologically. But, no winners regardless of the outcome.

    A slap in the face and a wouund to the soul for all those concerned.

    One thing that occurred to me is, with a 200k bail–what is the gravity of the summons? The first thing that came to mind was rape after reading the DT headline. Sexual assault, as stated, is it defined as exposure, indecency, groping, or rape???
    At any rate, this should not have happened–well, if it did–to be politically correct.

    I think we all need to take a step back and take a deep breath here. Everyone seems to be vascilating between “Sanchez raped this girl”, and “this girl is making stuff up”. The details are, the police have been very careful and adamant to only say this is a “sexual assault” case, and the woman was not taken to a hospital nor apparently given any sort of rape kit. Given the timeline of the story, the most likely scenario is that Mark “Dirty” Sanchez came back from the 9-0 trashed, started talking to a girl, and got a little gropey and aggressive against her wishes (wow, never seen drunk guys do that before…). She freaks out, goes back to her apartment, and ultimately decides to call the cops. In this case, if he laid a hand on her, grabbed her boob, or held her against her will and kissed her–all of those are “sexual assault”. And not necessarily felonious, but most likely a misdemeanor.

    In no way to I mean to excuse Sanchez’s behavior, but it does not appear that the sky is falling here. Sanchez will probably be punished, but hopefully his error was minor and won’t cost himself or the team too much, and hopefully he can learn to be a better gentleman out of all this. In no way do I blame the girl in this scenario, she was well within her rights to call the cops if Sanchez groped her.

    USC is taking it in the rump with this story and the Bush story, and the more you have cops and NCAA compliance jerks snooping around, the greater probability of long-term harm, so I’m as nervous and gloomy as any other Trojan. But let’s wait for the facts to come out.

    On KNBC, a reporter was interviewing a USC co-ed who was sympathetic to Sanchez. She had big doubts about the allegation. But she told the reporter something I found profoundly disturbing.

    Have y’all seen the tape of Sanchez leaving the Gardens in handcuffs? It’s the only video of this event and it was shot by a female DT staffer.

    The co-ed told the KNBC reporter that as the DT reporter was shooting the video, official USC functionaries, from (paraphrase) “the football team and the publicity office” commanded that she cease taping. They further stated that she was hurting “our school” by her actions. The co-ed witnessed the above described behavior by the school officials.

    If anything remotely like this happened, it affirms absolutely everything Trojan-haters say regarding the complicity of the school in squashing the truth around extra-benefits and eligibility of USC athletes.

    I fear for the accuser’s future. I am completely convinced she will undergo a character debasement similar to the one we are witnessing at Duke.

    What does Tim Tessalone have to say about the “witness intimidation” alleged? Bueller? Anybody?

    Correction - it was a student from the USC Annenberg tv school, not a DT staffer.

    The photographer went on the record annonymously and stated she had received threats and was concerned for her welfare. She did not name the source of any thret.

    that’s the annenberg school of journalism — both broadcast and print journalism students study there, and print majors must be proficient in broadcast journalism and vice versa to graduate.

    If that’s true, it’s changed since 2003 when I graduated. I never took a single broadcast class. The broadcast majors tended to complain about the fact that they have to take “print” classes like Newswriting and Reporting; they argued that the style of writing is so different that it was a waste of time… whereas we print majors never had to take broadcast classes.

    It certainly sounds like Sanchez is guilty of posession of fake ID and being where he shouldn’t be (caught on tape at the 9-0, drunk or not). Whether or not the DA chooses to charge him on those charges, he ought to be in for some disciplinary action from PC. Any speculations on that?

    The 9-0 glancing over fake IDs? I’m stunned. I graduated last year and without hyperbole I claim that at any time 2/3rds of the people in there are underage at anyone time. Two of my best stories, one from before it was briefly shut down for serving underaged and one from when it reopened.

    Before it was shut down, they had a door near the bathroom that led to the outside except it had a wrought iron security door. Well they left the inside door slightly open; you go inside with your ID, slip it to someone on the outside through the bars of the secuirty door and then they enter.

    After it reopened I was standing in line in front of any asian guy. The ID he handed security (I don’t know if it was real or fake) was some blonde headed white guy.     Brendan, I threw in the disclaimer because although I don’t mind ignorantly being labeled a racist or bigot or whatever, I do mind being labeled a homer. I love USC and will always look for the brightest nuggets, but I’m a realist and expect that shit will happen and the university and the athletic department need to deal with it properly.

    Is anyone else confused by the excerpt stating that it would take 10 minutes to walk from Cardinal Gardens to the 9-0? The two are significantly closer than that. I suppose if you were already drunk…or possibly on crutches…

    The 9-0’s lax security isn’t the issue here. I never even needed a fake ID at SC… but I wasn’t on the football team, presumably in training and/or instructed not to be out drinking.

    Of course, maybe discipline is so lacking on the team that this kind of stuff doesn’t matter. I hope that’s not the case, and if it isn’t, an example needs to be made.
