Mahoney’s biggest liability, from the Right’s perspective, is her position in favor of affirmative action. Not only did she argue the case for the University of Michigan, but according to PoliPundit, she addressed it from a personal perspective: “I’m a Republican, and there’s a common misconception that all Republicans oppose affirmative action. I care deeply about this case.”

I wonder why the President didn’t nominate her in the first place. However, it seems like it is down to Alito and Luttig.

“Seems” being the operative word … just as it “seemed” to be Edith Brown Clement all day, until it actually turned out to be Roberts.
(That’s not to say it *won’t* be Alito or Luttig … just that there’s no correlation between the names most often mentioned in the media prior to the nomination and the name actually submitted for the nomination.)
